GENERAL

IFix is a division of iFix nz. Any reference made on this website to “iFix” refers also to iFix Nz. The terms “iFix”, “ifixnz.co.nz“, and “iFix nz” are used interchangeably. The terms “you”, “your”, and “customer” has its general meaning, and also applies to any visitors of the site ifixnz.co.nz, as well as any persons submitting a device for observation/repair at iFix, including the owner of said device(s).GST
All repairs are excluding gst. (Prices on this website are excluding gst)

PRIVACY POLICY

IFix knows that you care how information about you is used and shared, and we appreciate your trust and want you to feel confident in our services and security as it relates to your personal information. The information we learn from customers helps us personalize and continually improve our services to you. We receive and store any information you enter on our Web site or give us in any other way. You can choose not to provide certain information, but then you might not be able to take advantage of many of our features. We use the information that you provide for such purposes as responding to your requests, fulfilling orders, improving our store features, and communication with you. We respect your privacy and appreciate your business. At no time do we ever provide your account contact or payment information to any third party vendor, associate or service provider unless absolutely necessary in order to complete your transaction and order. We work to protect the security of your information during transmission by using Secure Socket Layer (SSL) software, which encrypts information you provide to us for purchasing of our products or services. We reveal only the last five digits of your credit card numbers when confirming an order. Of course, we transmit the entire credit card number to the appropriate credit card company during order processing. If you choose to visit iFix, your visit and any dispute over privacy is subject to this Privacy Policy and our Terms & Conditions, including limitations on damages, arbitration of disputes, and application of the law of the state and or country. If you have any concern about privacy of your personal information as used and collected within our website, please send us a thorough description by clicking on the ”Contact Us” link on the side menu, and we will try to resolve it. Unless stated otherwise, our current Privacy Policy applies to all information that we have about you and your account. We stand behind the promises we make and will never materially change our policies and practices to make them less protective of customer information collected in the past without the consent of affected customers.

ELECTRONIC COMMUNICATIONS

When you visit iFix or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

CONSUMERS GUARANTEES ACT 1993 Nothing in the Terms & Conditions is intended to have the effect of contracting out of the Consumer Guarantees Act 1993 (“the Act”) except to the extent permitted by the Act and the Terms & Conditions are to be modified to the extent necessary to give effect to that intention. Where the Act applies to these Terms & Conditions: If the products are acquired by you for business purposes, you agree that the Act does not apply; and If the products are not acquired by you for business purposes, we reserve the right to replace any Products which fail to comply with any guarantee contained in the Act. You acknowledge that we do not provide any Express Guarantees (as defined in the Consumer Guarantees Act 1993) other than those expressly confirmed by us in writing.

APPLICABLE LAW

By visiting iFixnz.co.nz, you agree that the laws of New Zealand, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and iFix/iFix Nz or its associates.

RISK OF LOSS

All devices and items shipped from iFix to you is made pursuant to a shipment contract. This means that the risk of loss and title for such items passes on to you upon our delivery to the carrier.

DISCLAIMER OF WARRANTIES AND LIABILITYTHIS

SITE IS PROVIDED BY IFIX ON AN “:AS IS”: AND “:AS AVAILABLE”: BASIS. IFIX MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THIS SITE OR THE INFORMATION, CONTENT, MATERIALS, OR PRODUCTS INCLUDED ON THIS SITE. YOU EXPRESSLY AGREE THAT YOUR USE OF THIS SITE IS AT YOUR SOLE RISK. TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, IFIX DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. CERTAIN LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.

WARRANTY

Devices found to be liquid/sand/tabacco contaminated or misused may, at the discretion of the repairer, be excluded from all warranties. The customer is responsible for all data stored on their devices, PLEASE BACKUP YOUR DATA prior to sending device for repair. An assessment fee of $49 incl. gst will be payable if the device is found either not covered by warranty, or excluded from warranty due to user error.
Unless otherwise specified, all repairs carry a 3 months M/D parts warranty from the date of collection. Where the product has a balance of a new warranty remaining, the greater of 1 month or the balance of the new warranty applies. Service warranty on the repair is performed to address the specific fault stated. Any previously undiagnosed or subsequent faults are not covered by the warranty, and will be handled as separate repairs. We will meet all obligations under the Consumer Guarantees Act 1993.

UNLOCKING DISCLAIMER

Mobile Phone Unlocking means that iFix will unlock the phone to be used in New Zealand. The phone will thereafter be able to take a New Zealand sim card and make and receive calls in New Zealand.
This service does not cover any existing faults on the phone, known or otherwise, such as sending texts, charging function, internet access, multimedia service, and any other related phone functions.
Some phones may require a software upgrade or downgrade in order to perform the unlocking procedure. THIS CAN CAUSE THE LOSS OF DATA AND SETTINGS ON THE PHONE. The customer is hereby advised of this fact, and is solely responsible for backing up the contents of the phone. iFix, and any of the associated management and staff accepts no responsibility or liability related to data loss.

PHONE SECURITY OR PIN UNLOCK DISCLAIMER

All phone data and settings will be erased for this procedure. This is NOT REVERSIBLE. The customer is thereby advised to back up all data and settings before this procedure.
This procedure will allow access to normal phone functions. It does not cover any existing faults, known or unknown.
If the customer’s phone is found to be blacklisted (meaning the phone is reported as lost or stolen and subsequently barred on New Zealand mobile networks), the customer is still liable to pay the unlocking fee.

LIQUID DAMAGED DEVICE DISCLAIMER

There is NO WARRANTY on any liquid damaged repairs due to the nature of the repair. Even if the device appears to be working before the repair, there will be corrosion within the device, which can result in a short circuit while the device is being cleaned and flushed, or at any time thereafter. A short circuit will result in hardware or software failure, and resulting loss of data/settings and functionality. This is a common problem related to internal corrosion and not a procedure fault. Device manufacturers refuse to repair a liquid damaged device due to the nature of the repair. The Customer is hereby warned that there is a substantial failure rate. iFix nz accept no responsibility for this failure rate, and will only attempt a liquid damaged device repair upon the Customer understanding the risk of failure and agreeing to assume all risk. The inspection fee charged is non-refundable regardless of whether the device is repaired or not. This reflects the time investment by our technicians in attempting to repair the device. If the device can be repaired, the inspection fee will be deducted from the service charge. We reserve the right to requote as there is no telling which components need to be replaced before a thorough inspection, or due to the failure rate in this nature of repair. Parts that are replaced during the repair come with a 3 month manufacturer’s warranty only for manufacturer defects. This warranty does not cover improper use by the Customer. This warranty is also invalidated if the device is taken apart by an unauthorised service centre or other unauthorised persons.

TOUCH SCREEN/GLASS REPLACEMENT DISCLAIMER

When repairing the touch screen/glass on a device, there is a 5% chance that the LCD can be damaged. This will result in the need to replace the entire LCD which will cost significantly more. IFIX Nz will only attempt this type of repair if the customer understands and agrees to undertake the risk involved. We cannot perform the repair otherwise, as we are unable to accept any liability for damage to the LCD.
